Das weit uber die Zeit seiner Abfassung und uber die Grenzen seines Entstehungslandes hinaus unter dem Namen "Qabusname" bekannte, literarisch wie kulturgeschichtlich bedeutsame Werk heisst wortlich "Buch der Ratschlage," persisch "nasihat-name." Sein Verfasser Kej Kawus wurde um 1021/22 n.Chr. geboren und genoss die fur die persischen Furstensohne seit Jahrhunderten vorgeschriebene Erziehung, bei der eine Synthese von ritterlichen und geistigen, vornehmlich religiosen Tugenden angestrebt wurde. Es handelt sich um eines der interessantesten und eigenartigsten Erzeugnisse der mittelalterlichen iranischen Literatur. Mit Recht werden (...) der intime Ton des Werks und die reizvolle Schlichtheit der hubschen Anekdoten sowie die auf Schmuck verzichtende Einfachheit der Erzahlkunst geruhmt. Die vorliegende Ubersetzung des "Qabusname" ist die erste in deutscher Sprache, die nach dem persischen Original vorgenommen wurde. Die einzige fruhere deutsche Ubersetzung des Orientalisten H. F. von Diez erfolgte aus dem Turkischen und wurde 1811 veroffentlicht. Schon Goethe beschaftigte sich bei seiner Begegnung mit dem klassischen Schrifttum der Perser unter der Fuhrung H. F. von Diez eindringlich mit dem Qabusname. Der Beziehung des Dichters zu diesem so bedeutsamen Stuck der persischen Literatur ist daher ein besonderes Kapitel gewidmet. (shrink)

This article provides current Schwartz Values Survey data from samples of business managers and professionals across 50 societies that are culturally and socioeconomically diverse. We report the society scores for SVS values dimensions for both individual- and societallevel analyses. At the individual- level, we report on the ten circumplex values sub- dimensions and two sets of values dimensions. At the societal- level, we report on the values dimensions of embeddedness, hierarchy, mastery, affective autonomy, intellectual autonomy, egalitarianism, and harmony. Nghiên cứu sự phát triển của Nho giáo từ thời kỳ Cổ đại đến khi học thuyết của Khổng Tử ra đời, giới thiệu những bộ sách, môn đồ, tư tưởng của Khổng Tử qua các thời kỳ phát triển của đất nước Trung Hoa. Giới thiệu quá trình phát triển của Nho giáo ở Việt Nam. Mỗi thời kỳ đều gắn với tên tuổi của các nhà Nho hoặc giáo phái lớn.

Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. On study and teaching of aesthetics in Vietnam.

Associations between cardiorespiratory fitness and brain health in healthy older adults have been reported using a variety of cardiorespiratory fitness estimates. Using commonly used methods to determine CRF, we assessed the relationship between CRFe and executive function performance. Healthy older adults, underwent three CRF tests: a Maximal Graded Exercise Test performed on a cycle ergometer, the Rockport Fitness Walking Test, and a Non-Exercise Prediction Equation. Executive function was assessed by a computerized cognitive assessment using an N-Back task and a Stroop (...) task. Multiple hierarchical regression analyses were conducted to assess the relationship between different CRFe and executive function performance. Regardless of age and education, cardiorespiratory fitness estimated from the Maximal Graded Exercise Test and the Rockport Fitness Walking Test was significantly associated with the global switch cost. All CRFe were associated with the interference cost. No association was observed between CRFe and local switching costs or the updating costs. In the present study, not all subcomponents of executive function were related to CRFe. Interestingly, the executive functions that were associated with CRFe are those that are known to be the most affected by aging. (shrink)

Cosmology and the development of human society.

Traditional state v. state war is largely a relic. How then does a nation-state protect itself - preemptively - against the unseen enemy? Existing international law - the Caroline Doctrine, UN Charter Article 51, Security Council Resolutions 1368 and 1373 - do not provide sufficiently clear guidelines regarding when a state may take preemptive or anticipatory action against a non-state actor. This article proposes rearticulating international law to allow a state to act earlier provided sufficient intelligence is available. After examining (...) international law, this article proposes a process-based "strict-scrutiny" approach to self-defense. Under this approach, the executive will have to convince a court, based on relevant, reliable, viable, and corroborated intelligence, that preemptive action is appropriate. This process leads to a check on the power o the executive by placing a judicial check on preemptive action, consequently establishing objective legal criteria for operational counterterrorism. Muge Kinacioglu, Department of International Relations, Bilkent, University, Turkey, wrote a response to my article titled, "A Response to Amos Guiora: Reassessing the Parameters of the Use of Force in the Age of Terrorism: Pre-emptive Action and International Law." La fiction historique dont nous parlons ici a vu le jour par rapport à la pensée de l'écriture, ou de l'inscription, telle qu'elle a eu lieu dans le travail de Jacques Derrida des années 60. Au coeur de ce travail, il y a trois textes publiés en 1967 : La voix et le phénomène, De la grammatologie, L'écriture et la différence. Traverser ces travaux revient à traverser : premièrement, l'imagination du mot, qui n'était pour Husserl que pure fiction ; deuxièmement, (...) l'imagination comme séparation de la nature dans la nature chez Rousseau ; et troisièmement, la fiction comme imaginaire dans le cas du structuralisme littéraire, au-delà duquel a lieu la fiction sans imaginaire de Mallarmé. Juste avant ces travaux il y a, dans l'oeuvre publiée, le moment où la fiction historique commence à percer ; juste après, le moment où ses fondements ont déjà été établis : l''Introduction' à L'Origine de la géométrie de Husserl et 'La double séance' dans La dissémination, respectivement. C'est également l'espace compris entre le problème de l'historicité et celui d'une littérature sans condition. À cet espace appartient la possibilité de 'devenir une chose littéraire' de tout texte 'confié à l'espace public [...] dont le contenu, le sens, le référent, le signataire et le destinataire ne sont pas des réalités pleinement déterminables, des réalités à la fois non-fictives ou pures de toute fiction...' El déjà vu es problemático en el fin de siglo (XIX), no por la ensoñación poética que trae consigo, sino por la perturbación que le causa a la vida. De allí la preocupación de los “savants” por entenderlo, controlarlo y “curarlo”. El déjà vu irrumpe en la vida cotidiana del sujeto, lo perturba, lo desconcierta. De allí que Bodei lo relacione con el eterno retorno de Nietzsche. Más que un caso aislado o “patológico” ligado a individuos “pa(de)cientes” como los epilépticos, (...) o una “válvula de escape de la realidad”, el déjà vu sería para Bodei, la irrupción (la erupción) de una ilusión frente a la realidad “operante”. El déjà vu pone en crisis la supuesta identidad “absoluta” del sujeto, su dimensión del tiempo y su “confianza” en la continuidad de la personalidad. Para hablar de él es necesario, como sugiere Bodei, referirse al tema del “doble” en la literatura del siglo XIX. (Dostoievski más que Stevenson). (shrink)

L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

Dans des études diachroniques et synchroniques récentes, on constate une convergence vers l’idée que l’analyse de des fonctionnant comme article (« article-like » des, désormais desal) ne doit pas être fondée sur une relation avec les partitifs. Cette contribution reprend ce débat et montrera que les approches proposées pour contourner une analyse partitive de desal entraînent pourtant un certain nombre de défis. L’identification de ces défis nous mène à élargir notre perspective vers les partitifs nus (c’est-à-dire des structures partitives sans (...) déterminant « upstairs », p. ex. de ces N) en français, italien et néerlandais. Surtout cette dernière langue est particulièrement intéressante, vu que les partitifs nus ne s’y sont pas fossilisés. Sur la base de ces données, nous proposerons une analyse de desal comme faisant partie de la famille des partitifs nus. Cette approche partitive de desa, qui rend compte de faits synchroniques et diachroniques, s’avère théoriquement plus élégante et a une couverture empirique plus large. (shrink)

Si on cherche une définition minimale de la phénoménologie, on trouvera l'idée de philosophie descriptive. En ce sens, on peut imputer quelque chose de phénoménologique á de nombreuses philosophies contemporaines, audelà des limites de la phénoménologie au sens étroit et historique du terme. Néanmoins, il faut alors prendre en compte la question de savoir ce qui est à décrire. La réponse phénoménologique est: ce qui est vu. Qu'est-ce qui est donc vu ? Cette question est inséparable de celle de la (...) grammaire du voir. L'auteur soutient que c'est ce qui doit être retenu de la critique wittgensteinienne de la phénoménologie. Mais, si ce qui doit être dit est le vu en tant qu'il est dit, il n'en reste pas moins qu'il doit être dit en tant que vu. Que faire de cette dimension qui est celle de l'« être-vu » ? En ce point, la phénoménologie est inévitable, non plus comme discipline, mais au moins comme problème. If one requires a minimal definition for phenomenology, one may settle for the idea of a descriptive philosophy. In that sense, something phenomenological can be ascribed to many contemporary species of philosophiy, beyond the limits of « phenomenology » taken in a narrow, historical sense. However, the question arises : what is to be described? Phenomenology's answer is: what is seen. What, then, is seen ? This question is inseparable from the question of the grammar of seeing, as the author holds to be drawn from the wittgensteinian criticism of phenomenology. But if what is to be said is what is seen, as said, yet it remains that it is to be said as seen. What can be done with this « being-seen-ness » ? Here, phenomenology is unavoidable, not as a discipline anymore, but at least as a problem. (shrink)

Bu eserde, şeriat, tarikat, hakikat ve marifetin ne olduğu ele alınmıştır. Gerçek ve Hak dostları ile yalancı ve sahtekâr taklitçilerin özellikleri anlatılmaktadır.

Une classe capitaliste nationale peut-elle émerger dans les pays africains nouvellement indépendants? Débattue il y a quarante ans à propos du Kenya, la question se pose également pour l’Éthiopie des trois dernières décennies. Bien que ce pays n’ait jamais été colonisé, son passage il y a trente ans d’un régime militaire à un État démocratique et développeur a marqué un tournant comparable à celui des pays africains anciennement colonisés. Cette transition politique promettait d’accorder un rôle économique plus important au secteur (...) privé national, jusqu’alors très limité. Cette transition s’est toutefois accompagnée d’importantes contradictions en matière de propriété du capital, compte tenu de la centralisation de la politique industrielle par l’État éthiopien. Cet article analyse les tentatives de l’État éthiopien de stimuler la formation d’une classe capitaliste productive et autochtone, dans le secteur des métaux et de l’ingénierie, au cours de la dernière décennie. We present our method for tackling a legal case retrieval task by introducing our method of encoding documents by summarizing them into continuous vector space via our phrase scoring framework utilizing deep neural networks. On the other hand, we explore the benefits from combining lexical features and latent features generated with neural networks. Our experiments show that lexical features and latent features generated with neural networks complement each other to improve the retrieval system performance. Furthermore, our experimental results suggest the (...) importance of case summarization in different aspects: using provided summaries and performing encoded summarization. Our approach achieved F1 of 65.6% and 57.6% on the experimental datasets of legal case retrieval tasks. (shrink)

Using a nationwide survey of provincial institutional quality and a sample of private manufacturing small and medium scale enterprises, this paper contributes to the literature by considering for the first time the effects of corruption on the financial performance of Vietnamese private SMEs. Interestingly, contrary to previous findings, we find that corruption when measured by a dummy variable, does not affect firms’ financial performance after controlling for heterogeneity, simultaneity and dynamic endogeneity. However, the intensity of bribery and the majority of (...) the forms of corruption were found to have negative impacts on firms’ financial performance. Hence, a typical approach using only a dummy variable for bribery might not adequately evaluate the impact of bribe intensity or even ignores the negative impacts of some types of bribes on firms’ financial performance. The findings suggest that anti-corruption measures are vital for the development of the Vietnamese private SMEs. (shrink)

In this chapter, we aimed at further characterizing the functional neuroanatomy of the human rapid eye movement (REM) sleep at the population level. We carried out a meta-analysis of a large dataset of positron emission tomography (PET) scans acquired during wakefulness, slow wave sleep and REM sleep, and focused especially on the brain areas in which the activity diminishes during REM sleep. Results show that quiescent regions are confined to the inferior and middle frontal cortex and to the inferior parietal (...) lobule. Providing a plausible explanation for some of the features of dream reports, these findings may help in refining the concepts, which try to account for human cognition during REM sleep. In particular, we discuss the significance of these results to explain the alteration in executive processes, episodic memory retrieval and self representation during REM sleep dreaming as well as the incorporation of external stimuli into the dream narrative. This paper draws on an institutional logics perspective to illuminate a hitherto underexplored context for CSR professional identity construction. It draws on an empirical study of 65 CSR professionals in South Korea and aims to deepen our understanding of CSR professional identity construction by investigating the contested nature of the CSR professional field between, on the one hand, societal-normative expectations of the profession, and, in the absence of stable professional logics, CSR professionals’ desired professional identity, on the other. Our study (...) reveals how CSR professionals engage with, and respond to, this complexity through constructing one of three distinctive professional identities based on different logic constellations.
